Hey all. today i was invoved in a minor hit and run, (again
I stopped and other party did not. I then Filed a police report, and with out investigation held liable. to make matters worse, my father talked to the cop on the phone and now there is a formal complaint held against the officer, This resulted in me getting a 3 point ticket for "disobedience to lane assignment". This is due to the officer saying that my actions of signaling changing lane, and mid way between lanes the collision happened.
but first let me start with the citation that resulted in this minor accident.
On my way to school this morning my brother and i were in my celi on a major road heading across town, the one that we take everyday to and from school. I was behind a 1995-2000 silver 4runner, and at a major intersection i noticed her applying makeup and not paying attention to the traffic signals. The light then turned green and she didnt move, i flashed my lights and she then moved. Being behind a detracted slow driver is a pet peeve of mine, so i signaled and changed lanes into the center lane (there are 3 lanes on this stretch). and got behind another vehicle. My intentions were to change over and get in front of the detracted driver. I checked my mirrors, Blind spot she was a safe distance away, i signaled, and checked again as i started to move, she was a safe distance still. I began to change and then *Wham*, My tail end kicks out like im drifting, i lift off the throttle and see the 4 runner struggling to control the sway of the impact. i slow to about 25 miles an hour (speed limit is 35) and pull over on the next road apply my hazards and watch as the car turns behind me. I start to gather my information.
The Driver of the 4runner then drives up flips me off and tears away. I am lost on what to do at this point, i know i should have gotten a plate number so my case would be stronger against her. I call my dad he says to file a police report.
I call up the cops, return to the scene so that the report can be filed, telling the cop this he then says im at fault. call my dad listen to them argue for about 10 mins and then he hands the phone back says im done talking to your father your getting a ticket as i stated above. So now the cop is irritated, says a traffic detective will be on the case to find the 4runner. The details of my dad's discrepancy with the cop is he was not reasnoble and didnt give him the name of the supervisor or his badge number. That however is another issue.
Do you guys think im liable for this accident? If so i have to pay insurance increase and my license will be revoked due to point violations. Should i take this to court as planned or is there another option?

I know here in MD, you are not guilty if you were the person that was hit. I would take it to court. Hell no would I want to pay the increase in my insurance because someone hit me.
Not my fault they plowed me, and not my fault they left the scene not to return. Why do I have to pay the increase.
Any witnesses?

yeah im pretty pissed at the whole incicent, yes actually a friend infront of me saw our cars move, but that's about it.

Damn, that sucks Matt. Your friend will be an important part of the incident (as for he seen what happened). Well, lol you can always tell your story to a news station (they're always lookin' for something). Plus, the news would even interview the police officer.
It sucks! Trying to take this matter to court is $pendy. And the court will more than likely be in favor of a Police Officer than a young kid (that's what's really shitty). IDK!
Is your car all messed up?

Matt, your life is never dull is it? This doesn't sound like you were at fault. The culprit is the person who was putting on her war paint. Sounds like you have to accept defeat if you haven't got the third party details. Yes its a PITA, I know.

Damn Matt...that sucks...Sounds to me like she's pretty guilty, if she wasn't why would she have run? I'd personally fight it, but I don't know the laws in CO (is that right?). It's a bummer you didn't get the plate # and it sounds like the cop was either having a bad day or just being an ass...
I hope things work out with this....

ha ha Steve sometimes i think i drive a magnet, people just cant seem to keep from hitting me, and yeah i get to pay a nice fine and loose more points on my license oh joy of joys.the state has told me another incident and i loose my license. I hope things work out with this.... and yeah she gave me the nice one finger salute as she drove off too. yeah i want to but sense im not 18 untill june techicly its my parents decision, my dad said pay the fine and forget the incident, yea she had no front plate and speed off to fast, well that bad day will get worse, we are fieling a legal complaint with him. His attitude and his  will be brought before his supravior and a court. bad day to mess with my dad, and me, in 20 mins of it happing the lawyer at my dads job (good friend of his) was on the phone with the denver police department decussing how the policys were violated. and finally here is the damage from today.  impact broke and cracked and messed up the bondo repair, shoved the bumper back in, cracked my tail light, and re dented most of the passenger side panel.

yeah it wasnt a super duper repair i needed to paint it again with some  paint. the bumper was fixed and i think she was late to work hopefully. I saw her car again, tried to get the plate but she cut off 3 people and speed away.

Glad your dad's persuing the cop's attitude problem. I personally don't understand how you could get a citation when she was the one that ran...let alone the distracted and aggressive  . I'd be absolutely livid. That's a tough spot to work the metal back out on that corner, You should be able to get the wheel well straightened back out though... Do you have a resource for a new tail light?

Do what others do on MW2...camp...wait until you see her drive by, then get that plate! And also, don't forget the camera to take pics of her front bumper after she parks/leaves.

Do you have a resource for a new tail light? yeah the cop was way out of line imo. and well i can think of one, Im a 17 y/o asian male in a asian sports car with a coffee can muffler, i think the cop assumed i was the one who was aggressive and made a "unsafe lane change" making me at fault. and i am, still im going to find her and resist the urge to put my tire iron through her windshield. i know if i get her plate number and the cops get her, she will be put in jail for holding, car towed and impounded shes running from 24-36 points. she wont drive for years.
